3. Counter-Notification Procedure
If you believe that content you submitted or posted was removed or disabled as a result of a mistake or misidentification, you may submit a counter-notification. A valid counter-notification must include the following:
- Your physical or electronic signature.
- Identification of the material that has been removed or disabled and the location at which the material appeared before it was removed or access to it was disabled.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
- Your full name, mailing address, telephone number, and email address.
- A statement that you consent to the jurisdiction of a competent court and that you will accept service of process from the person who submitted the original infringement notice or their agent.
Upon receipt of a valid counter-notification, we will process it in accordance with applicable law and may reinstate the removed content within the timeframe permitted under applicable procedures, unless the original complainant files a court action seeking to restrain the alleged infringement.
4. Repeat Infringer Policy
We maintain a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers. A user may be considered a repeat infringer if they have been the subject of multiple valid copyright infringement notices. We reserve the right to make this determination at our sole discretion based on the information available to us.
5. Misrepresentation
Please be aware that submitting a notice of copyright infringement or a counter-notification with knowingly false or misleading information may expose you to legal liability. Misrepresentation of material facts in a notice or counter-notification is a serious matter. We strongly encourage you to seek legal advice before submitting any notice if you are uncertain about whether the material in question is infringing.
6. Modifications to Infringing Content
In some cases, rather than removing content entirely, we may work with users to modify or replace content that is alleged to be infringing. This approach is taken at our discretion and does not affect our right to remove content or take other appropriate action when warranted.
7. Limitations of Liability
We are not in a position to adjudicate disputes between copyright holders and users. Our response to DMCA notices is a procedural measure taken in good faith. We do not make legal determinations regarding whether specific content is infringing. We disclaim any liability arising from actions taken in good faith in response to valid or apparently valid notices.
8. Third-Party Content
Our platform may host or link to content submitted by users or third parties. We do not monitor all user-submitted content proactively, but we respond promptly to valid infringement notices. Removal of content in response to a notice does not constitute an admission that the content was infringing or that we bear any legal responsibility for the content in question.
